Mediation and the Provincial
Court

WHAT IS THE CIVIL CLAIMS PROGRAM?

Mediation is a new option available to individuals involved in a civil claim dispute. Alberta Justice has initiated the civil claims mediation program to provide an opportunity to resolve civil claims without a trial.

WHAT IS MEDIATION?

Mediation is a method for resolving disputes. A mediator helps the parties in a dispute reach an agreement. It is an informal, private way to settle a civil claim without going to Court. In mediation a decision is not imposed, the parties themselves determine the outcome.

WHAT HAPPENS IN MEDIATION?

In a mediation session each person is given an equal chance to describe and discuss the sources of conflict. The mediators assist the participants in developing options and finding a mutually acceptable solution. A written record of the agreement is prepared.

The Benefits of Mediation

MUTUAL SATISFACTION
A goal of mediation is to reach agreements that address the concerns and needs of all parties involved in a dispute.

PARTICIPANT DRIVEN
The parties control the outcome of the mediation. A mediated solution may include terms that the Court could not impose.

EFFICIENCY
Resolution of a dispute can often be accomplished more quickly by mediation than litigation. A typical mediation will take about two hours.

COST
There is no charge for mediation services.

CONFIDENTIALITY
The discussion and documentation in the mediation session is treated by all parties as confidential. It is not admissible in Court proceedings.

SUCCESS
The Civil Claims Mediation Program has experienced a success rate of over 70%.

THE MEDIATORS ROLE

Mediators are neutral. Their job is to assist the parties in discussing the problem and finding a mutually satisfactory solution. The mediator's job is not to judge who is right or wrong or to find fault or assign blame.

THE ROLE OF COUNSEL / AGENT

Lawyers and agents are not usually involved in mediation but you may have them attend with you. It may be advisable for you to consult a lawyer about your legal rights before attending.

WHAT IF WE DO NOT SETTLE?

Mediation has been successful for many people but it does not work for everyone. If you are not able to reach a settlement in mediation, your case will proceed to trial.


Mediation Can Work for You

The Court may schedule your case for mediation or you may request a mediation appointment. Mediation sessions are scheduled weekdays, evenings and Saturdays and take place at the Law Courts. You will receive a letter from the Court to advise you of the date and time of your appointment.
